KAYPIC.COM: THE PLATFORM GENERAL AGREEMENT FOR THE USERS

All actions and decisions respecting the management, operation, and control of the management platform KAYPIC.COM is the sole responsibility of ‘’TEVNAR IT GROUP CORP.’’ AS REFERRED IN THIS DOCUMENT .

 

The Terms and Conditions of service, and Privacy Policies, in accordance with the User License Agreement ("EULA"), guarantee the 'good and proper’ use and exploitation of the management platform KAYPIC.COM.

 

USER AGREEMENT

These Privacy Policy, and Terms and Conditions constitute the agreement between you and TEVNAR IT GROUP CORP. or any of its officially mandated body in respect to your use of the Service and the platform (the "Agreement").

 

PRIVACY POLICY

TEVNAR IT GROUP CORP. is committed to protecting user privacy, confidentially and the security of any information submitted to us. Any information that a user provides TEVNAR IT GROUP CORP. with is subject to our Privacy Policy, which governs our collection and use of your information. Through the use of the Services, a user consents to the collection and use (as set forth in the Privacy Policy) of this information, including the transfer of this information to Canada and/or other countries for storage, processing and use by TEVNAR IT GROUP CORP. As part of providing all users the services, we may need to provide users with certain communications, such as service announcements, controlled advertisements, contests, and administrative messages. These communications are considered part of the Services and your KAYPIC.COM services or account, which you may not be able to opt-out from receiving when you possess an active account.

 

The information we collect is use to improve the content of our web pages, and the quality of our service, and is not shared with or sold to other organizations for commercial purposes, except to provide products or services you have requested, when we have your permission or under the following circumstances:

 

  It is necessary to share information in order to investigate, prevent, or take action regarding illegal activities, suspected fraud, spasm, hacking, situations involving potential threats to the physical safety of any person, violations of Terms of Service of the specific application, or as otherwise required by local, states and federal laws.

  We could transfer information about a user if TEVNAR IT GROUP CORP. is acquired by or merged with another company. In this event, TEVNAR IT GROUP CORP. will notify you before your information is transferred and becomes subject to a different privacy policy.

1.  This platform and its owners take a proactive approach to user privacy and ensure the necessary steps are taken to protect the privacy of its users throughout their visiting experience. 3.  Registration

 

3.1.   In order to use this platform, a user may complete a registration form. During registration, a user is required to give certain information (such as name and email address). This information is used to contact you about the products/services on our site in which you have expressed interest. At your option, you may also provide demographic information (such as location etc.) about yourself or organization.

 

4.  Your consent

 

4.1.  By creating and using an account, you consent and agree, that you have read and accepted The Privacy Policy and Terms and Conditions for using our site.

 

4.2.  By using the Interactive Management Platform and/or using an account, you consent and agree that all content posted on the website belongs to KAYPIC.COM unless copyrighted and/or an Intellectual property. All users discharges or exempts KAYPIC.COM and its affiliates from any responsibilities (loss, damage, fraud, lawsuit, claims, infringement etc.) related to the personal use of the Management Platform directly or indirectly or for services rendered by any third party or intermediary in order to execute, provide, enhance a service by KAYPIC.COM to any user, entity or organization, as a casual or permanent customer, of KAYPIC.COM (ex.: Stripe, Paypal, Amazon, Azure etc.).

 

4.3.   By using the Interactive Management Platform and/or using an account, you consent and agree to use it for the intended purpose thus, management, and not for illegal, propaganda or immoral usage.

4.4.   Application of The Children’s Online Privacy Protection Act (“COPPA”). This section is aimed to inform parents and legal guardians on how this Management Platform collects, uses, and discloses personal information, when applicable, to children under the age of 14. The Privacy Protection Act also requires that the “service providers” obtain parental consent before we allow children under the age of 14 to use certain features from the online services or Management platform and subsequent services.

4.5.   As a service provider, we use reasonable means to preserve the integrity and security of all information collected through the management platform and our peripheral. However, no security system is unbreachable, thus we cannot guarantee the security of our systems. In the event that any information under our control is compromised as a result of a breach of security, we will take reasonable actions to investigate the incident and where necessary, notify those users whose information may have been compromised and yet, adopt the appropriate actions, in accordance with any applicable state of federal laws and regulations to rectify the situation.

4.6.   As a service provider, we may partner with third parties to provide services and content via our management platform. These third parties have their own privacy policy regarding the use and collecting of data. Hence, we do not exercise control over those practices of these third operative user parties.

4.7.   That being said, our management platform sets forth a structure in which a third party operative user is required to publish their own “Privacy Policy” and “Terms of Conditions” when collecting and using information for children who are over and under the age of 14. This information is collected concurrently regardless of age but in the instance of a child under 14, the parent’s or legal guardian consent should be prioritized. The age of 14 is used as it is stated legally for example with “Le Code Civil du Québec” or in Canada. It may vary from different states or countries, but the spirit of the measure is still the same, to protect children under age and to make sure the consentment of the legal guardian or parents have been obtained and granted. 

4.8.   Parent consent is interpreted as allowed if the parents or legal guardians engage an action by registration and payment for their child’s participation in an activities: by subscribing to a service, by acceptance via an “email”, “SMS or MMS” sent to the parent whereby an account (includes: full name, adresse, age, phone number, email address, pictures and other biographical info), profile or registration is being created on behalf of the child or else, the third party service provider can confirms the parent acceptance. Hence, by using or accessing our services, or allowing your children to use or access the services, the “parents or legal guardians” accept the practices described in the Privacy Policies.

 

5.  Online privacy Policy Only


5.1.    This online Privacy Policy applies only to information collected through our platform and not to information-collected offline.

 

6.  Your Access, your Rights and Control as data subject – For KAYPIC.COM Accounts and mobile APP

 

6.1.   As an individual or organization, you may exercise your right to access the data held about you by this company by submitting your request in writing to the data controller. Although all reasonable efforts will be made to keep your information updated, you are kindly requested to inform us of any change referring to the personal data held by the organization. In any case, if you consider that certain information about you is inaccurate, you may request rectification of such data. 6.2.   The interactive management platform KAYPIC.COM provides a variety of ranges and services to its users. Hence, we are primarily a “Service Provider” entity.  The information we collect is also used to improve the content of our APP experience usage from a practical point of view, to increase the efficiency of our service and to consolidate the operative readiness of the APP. The information  is not shared with or sold to other organizations for commercial purposes, except to provide products or services you have requested via the operative user (third party).

6.3.   This section explains the handling and operating of all the information regarding the use of the mobile APP. The interactive APP gathers information via its usage. Please read carefully before downloading.

6.4.   The Third party User is primarily responsible for processing data collected by the app.

6.5.   The App's data collection: We collect (Librairies and SDKs) data in order to transmit the information from the app off a user’s operation device (third-party operative user).

6.6.   The App’s data sharing: We transfer user data collected from the app to a third party per; Off device such as server to server transfers; Ondevice such as transfer to another app; from the App libraries and SDKs; From webview which has been opened through the app.

6.7.   The App’s Sharing: The App collects certain data, when users provide information, they can opt-out, or opt-in to have the data collected . The data type collected by the App can therefore be “optional” or “required.” “Optional” includes the ability to opt into or opt out of data collection.

6.8.   The app’s privacy and security practices: The data collected or shared by the App can use encryption in transit to protect the flow of user data from the end user’s device to the server. We prioritize data transferring over a secure connection as long as the “third party” uses best industry standards to safely encrypt data while it travels between a user’s device and the app’s servers.

6.9.   The App’s Data type information collection and Purposes are:

Category: Location - DATA TYPE:  Approximate location - PURPOSES:  user localization.

Category: Personal Info - DATA TYPE: Name, email address, User IDs, Address, Phone number, other necessary info - PURPOSES: to identify, authenticate user.

Category:  Financial info - DATA TYPE: User payment info, purchase history, other - PURPOSES: to complete a transaction and obtain a service by a ‘third-party” service provider.

Category: Messages: DATA TYPE: Emails, SMS or MMS - PURPOSES: to communicate bilaterally.

Category: Photos and Videos - DATA TYPE: Photos, videos - Purposes: users to provide content to a third-party service provider.

Category: Calendar - DATA TYPE: Calendar event - PURPOSES: to attend and plan events.

Category:  Contact - DATA TYPE: Contacts - PURPOSES - to communicate bilaterally.

Category: App Activity - DATA TYPE App interactions, installed Apps, other actions - PURPOSES: User interaction with the APP etc.

Category: App Info and performance - DATA TYPE: Crash logs, App performance, Analytics, Advertising and Marketing, fraud prevention security and compliance, personalization, account management - PURPOSES: to improve efficiency and limitate interruption of service, reinforce good use of the device.

6.10.   The App’s security practices and transparency: As an operative standard and obligation, it is mandatory to all “third-party service providers” users to post and publish their own privacy policies and terms and conditions on their respective devices (websites, APP etc.) in order to operate the interactive management platform Kaypic.com. This privacy policy applies solely to all information collected by this management platform and its derivatives and peripherals, such as an APP usage.

6.11.   Deletion menu option. This section explains our policies regarding the deletion option. At any time, a user can decide to delete his account by accessing the deleting menu section. Please take note, once you delete the data, you won't be able to retrieve any recorded transaction or data. It is the sole responsibility of the user to make sure when opting to delete your account. TEVNAR IT GROUP CORP. and its subsidiaries can’t be legally responsible for the loss, tempering of your account information, in any subsequent way, it is the responsibility of the users to make good practice of their account. Once you access the deletion menu option, a second pop-up question will ask you, if you are sure you want to delete your account. It is recommended that any financial transactions be printed for income tax purposes or government auditing periodically.

6.12.   This complete the The APP privacy Policy review. It is important for all users to read this section prior to downloading the APP. We are committed to protecting user privacy, confidentiality and reinforce the security of any information submitted to us or any third-party service provider.
